Consumer Limited Warranty Dated April 4, 2025

 

THREE (3) YEAR RELAX CHAIR FRAME & FABRIC LIMITED WARRANTY

Subject to the terms below, Assistance with Elegance LLC (“Assistance with Elegance”) warrants the Assistance with Elegance Chair (the “AWE Chair”) frame and fabric covering for three (3) years from the date of original purchase by the original purchaser, to be repaired or replaced at Assistance with Elegance’s option. 

 

THREE (3) YEAR ELECTRICAL PARTS WARRANTY

Subject to the terms below, Assistance with Elegance warrants the electrical parts of the AWE Chair, comprised of the motor and hand controller, against defects to original consumer only for a period of three (3) years from the date of original purchase by a consumer. 

 

TERMS APPLICABLE TO WARRANTIES

"Normal Use" means use in strict accordance with the installation, operation and maintenance manual. In the event that the AWE Chair does not conform to this warranty at any time while this warranty is in effect, Assistance with Elegance will correct the defect in conformity with this Consumer Limited Warranty. 

This warranty extends to the original purchaser, and is not transferable whether to heirs, subsequent owners, or otherwise. No affirmation of Assistance with Elegance by words or action, other than as set forth herein shall constitute a warranty.

If the AWE Chair is found by Assistance with Elegance to be defective in Normal Use (as defined below), such AWE Chair or applicable component thereof will, at its option, be replaced or repaired at Assistance with Elegance’s cost. “Normal Use” means use of the product as intended in strict accordance with the manual and any other accompanying documentation.

The parties hereto expressly agree that original purchaser's sole and exclusive remedy against Assistance with Elegance shall be on the repair or replacement of defective AWE Chair, or component thereof, as provided herein. 

This limited warranty DOES NOT cover any loss and/or damage due to:

  • Misuse or unusual use
  • Mishandling
  • Accident
  • Neglect
  • Acts of God. Relate to events outside human control, like flash floods, earthquakes, or other natural disasters.
  • Improper installation, if by purchaser
  • Exceeding the weight limit of the chair. Weight Limit is 350lbs.
  • Improper maintenance and care. Using abrasive cleaners such as powders, bleach, ammonia, alcohol, or chlorine, or steel wool, or wire brushes, as these will damage and wear down the fabric. 

Modifications (including but not limited to use of unauthorized parts or attachments), adjustment, or repair will void the warranty. Substituting another manufacturer's product and/or components will also void the warranty.

Normal wear and tear from daily use are not manufacturing defects and thus not covered by this warranty. For example, gloss reduction, scratching, staining, stretching, bowing, and alkaline etching of finishes over time, due to use, cleaning practices or water or atmospheric conditions, are not manufacturing defects but are indicative of normal wear and tear.

Please submit any warranty claim by sending an e-mail to info@assistancewithelegance.com. Please be sure to provide all pertinent information regarding your claim, including a copy of your original order confirmation, confirm the item number  of the defective item(s), a complete description of the problem, provide pictures or video evidence clearly showing the problem.

THE LIMITED WARRANTY SET FORTH ABOVE IS THE SOLE AND ENTIRE WARRANTY PERTAINING TO THE AWE CHAIR AND IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES OF ANY NATURE WHATSOEVER, WHETHER EXPRESS, IMPLIED, OR ARISING BY OPERATION OF LAW INCLUDING, BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS WARRANTY DOES NOT COVER OR PROVIDE FOR THE REIMBURSEMENT OR PAYMENT OF INCIDENTAL OR CONSEQUENTIAL DAMAGES.

SOME STATES DO NOT ALLOW THIS EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

ASSISTANCE WITH ELEGANCE SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES OR FOR ANY OTHER DAMAGE OR LOSS NOT CONTAINED IN THIS WARRANTY.

This warranty gives you specific legal rights, and you may also have other rights which may vary from state to state. All warranty claims must be approved by Assistance with Elegance before any service is performed.
